  1. ACCEPTANCE OF TERMS:

    PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE SERVICES. BY ACCESSING THIS SITE OR USING ANY PART OF THE SITE OR ANY CONTENT OR SERVICES (AS EACH IS DEFINED BELOW) ON THE SITE, YOU AGREE TO BECOME BOUND BY THESE TERMS AND CONDITIONS.     MODIFICATIONS OF TERMS OF USE

    MEDTING reserves the right, at its sole discretion, to modify or replace the Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, MEDTING will notify users via email or through the web site. What constitutes a "material change" will be determined at MEDTING's sole discretion, in good faith and using common sense and reasonable judgment. You shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Services by you following such notification constitutes your acceptance of the terms and conditions of the Terms of Use as modified.

  2. DESCRIPTION OF SERVICE:

    Subject to full compliance with the Terms of Use, MEDTING may offer to provide certain services and content, as described more fully on the Site, Services. Services shall include, but not be limited to, any service and content MEDTING performs for you, as well as the offering of any materials displayed or performed on the Site (including, but not limited to text, user comments, messages, information, data, graphics, news articles, photographs, images, illustrations, software, audio clips and video clips, also known as the ("Content") on the Site. MEDTING may change, suspend or discontinue the Services including any Content for any reason, at any time, including the availability of any feature or content. MEDTING may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.

    The contents of the MEDTING site, such as text, graphics, images and other material contained on the site ("Content") are for informational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

    MEDTING does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on the Site. Reliance on any information provided by MEDTING, MEDTING employees and users, others appearing on the Site at the invitation of MEDTING, or other visitors to the Site is solely at your own risk.

MEDTING or You are not permitted to advise, diagnose, or otherwise treat users of this Site. Neither the content nor any other service offered by or through this site is intended to be for medical diagnosis or treatment. Persons accessing this information assume full responsibility for the use of the information and agree that MEDTING is not responsible or liable for any claim, loss, or damage arising from the use of the information. MEDTING does not recommend or endorse any specific drugs, tests, physicians, products, procedures, opinions, "off-label" drug uses or other information that may be mentioned on the site. Your reliance upon the Materials obtained or used by You at or through this Site is solely at Your own risk.

  3. YOUR REGISTRATION OBLIGATIONS:

    As a condition to using Services, you are required to register with MEDTING and select a password and screen name ("MEDTING User ID"). You shall provide MEDTING with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms of Use, which may result in immediate termination of your MEDTING account. You may not select or use as a MEDTING User ID a name of another person with the intent to impersonate that person; (ii) use as a MEDTING User ID a name subject to any rights of a person other than you without appropriate authorization; (iii) use as a MEDTING User ID a name that is otherwise offensive, vulgar or obscene; or (iv) register at MEDTING if you are not a clinical professional. MEDTING reserves the right to refuse registration of, or cancel a MEDTING User ID in its discretion. You shall be responsible for maintaining the confidentiality of your MEDTING password.
    Services are available only to individuals who are at least 18 years old and are clinical professionals, whether acting on their own behalf or as an authorized employee or representative of a corporation or other business entity. If you do not so qualify, do not attempt to register for or use the Services.
    Once a registered participant, You may provide additional information in Your personal profile describing your credentials, professional experiences, academic background, biography and the like. Your personal profile shall be available for viewing by other registered participants of MEDTING and will be considered non-confidential and non-proprietary. Providing additional information in Your personal profile beyond what is required at registration is entirely optional and can be altered or removed by You at any time.

  4. USER CONDUCT:

    MEDTING permits the submission of content submitted by users ("Submissions") and the hosting, sharing, and/or publishing of such Submissions. You understand that whether or not such Submissions are published, MEDTING does not guarantee any confidentiality with respect to any submissions. You shall be solely responsible for your own Submissions and the consequences of posting or publishing them. In connection with Submissions, you affirm, represent, and/or warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize MEDTING to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Submissions. You also hereby grant each user of the MEDTING Website a non-exclusive license to access your Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such Submissions as permitted through the functionality of the Website and under these Terms of Service.
    As a condition of use, you promise not to use the Services for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose not reasonably intended by MEDTING.
    By way of example, and not as a limitation, you agree NOT to use the MEDTING Services:

    • To abuse, harass, threaten, impersonate or intimidate other MEDTING users
    • To contribute any Content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive or otherwise violates any law or right of any third party;
    • For any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
    • To post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any MEDTING user;
    • To create or submit unwanted email ("Spam") to any other MEDTING users or any URL;
    • To violate any laws in your jurisdiction (including but not limited to copyright laws);
    • To submit cases, images, videos, comments or other files not related to medical content and the issued topic;
    • With the exception of accessing RSS feeds, you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission. Additionally,
      (i) you agree that you will not: take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure;
      (ii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or
      (iii) bypass any measures we may use to prevent or restrict access to the Site;
    • With the intention of artificially inflating or altering the 'MEDTING count', blog count, comments, or any other MEDTING service, including by way of creating separate user accounts for the purpose of artificially altering MEDTING's services; giving or receiving money or other remuneration in exchange for votes; or participating in any other organized effort that in any way artificially alters the results of MEDTING's services.
    • To submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant MEDTING all of the license rights granted herein;

    MEDTING permits the submission of content submitted by users ("Submissions") and the hosting, sharing, and/or publishing of such Submissions. You understand that whether or not such Submissions are published, MEDTING does not guarantee any confidentiality with respect to any submissions. You shall be solely responsible for your own Submissions and the consequences of posting or publishing them. In connection with Submissions, you affirm, represent, and/or warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize MEDTING to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Submissions. You also hereby grant each user of the MEDTING Website a non-exclusive license to access your Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such Submissions as permitted through the functionality of the Website and under these Terms of Service. MEDTING may remove any Content and MEDTING accounts at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content), or for no reason at all.   5. Posts and Comments - Etiquettes for Visitors

    • Use of inappropriate username is forbidden.
    • Bad, foul or inappropriate language must not be used.
    • Threatening, insulting or abusive language or comments must not be made.
    • Racist comments must not be made.
    • Provocatove comments must not be made.
    • No form of spam may be posted.
    • No post may be made that could be considered provocative, its purpose just to start an argument.
  6. COPYRIGHT COMPLAINTS:

    MEDTING respects the intellectual property of others. It is MEDTING's policy to respond expeditiously to claims of copyright and other intellectual property infringement. MEDTING will promptly process and investigate notices of alleged infringement and will take appropriate actions.

    To notify about Copyright Infringement, send email to MEDTING - info [@] medting [dot] com. When we remove or disable access to content in response to an infringement notice, we will make reasonable attempts to contact the owner or administrator of the affected site or content. If you feel that your material does not constitute infringement, you may provide MEDTING with a counter notification.

  7. PATIENT DATA AND LEGAL COMPLIANCE:

    MEDTING does not allow the introduction of Patient Personal Information, although clinical case content and description may provide some information about patient charateristics to better define the clinical case.

    The Materials provided through the Site may enable You to transmit, store, review or receive confidential patient information ("Patient Information"). Countries and regional laws, as well as ethical and licensure requirements of Your profession may impose obligations with respect to patient confidentiality that may limit the ability of physicians, health care providers, and persons acting on their behalf, to make use of certain Materials or to transmit certain information to third parties. You represent and warrant that You will, at all times during the term of this Agreement and thereafter, comply with all laws directly or indirectly applicable to You that may now or hereafter govern the gathering, use, transmission, processing, receipt, reporting, disclosure, maintenance, and storage of the Patient Information, and use Your best efforts to cause all persons or entities under Your direction or control to comply with such laws. You are, at all times during the term of this Agreement and thereafter, solely responsible for obtaining and maintaining all patient consents, if applicable, and all other legally necessary consents or permissions required or advisable to disclose, process, retrieve, transmit, and view the Patient Information You transmit, store, or receive in connection with the Site, the Materials and any third party site. WE CANNOT AND DO NOT ASSUME ANY RESPONSIBILITY FOR YOUR USE OR MISUSE OF PATIENT INFORMATION OR OTHER INFORMATION TRANSMITTED, MONITORED, STORED OR RECEIVED WHILE USING THE SITE AND THE MATERIALS ON THE SITE. WE RESERVE THE RIGHT TO AMEND OR DELETE ANY MATERIAL (ALONG WITH THE RIGHT TO REVOKE ANY MEMBERSHIP OR R RESTRICT ACCESS TO MEDTING) THAT IN OUR SOLE DISCRETION VIOLATES THE ABOVE.

  8. INDEMNITY:

    You will indemnify and hold harmless MEDTING, its parents, subsidiaries, affiliates, customers, vendors, officers and employees from any liability, damage or cost (including reasonable attorneys. fees and cost) from any claim or demand made by any third party due to or arising out of your access to the Site, use of the Services, violation of the Terms of Use by you, or the infringement by you, or any third party using your account or MEDTING User ID, of any intellectual property or other right of any person or entity.

  9. WARRANTY DISCLAIMERS:

    You acknowledge that MEDTING has no control over, and no duty to take any action regarding: which users gain access to the Site; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content. You release MEDTING from all liability for you having acquired or not acquired Content through the Site. The Site may contain, or direct you to sites containing, information that some people may find offensive or inappropriate. MEDTING makes no representations concerning any content contained in or accessed through the Site, and MEDTING will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Site. THE SERVICE, CONTENT, AND SITE ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

  10. LINKS:

    The Services may provide, or third parties may provide, links to other World Wide Web sites or resources. Because MEDTING has no control over such sites and resources, you acknowledge and agree that MEDTING is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that MEDTING shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

  11. TERMINATION:

    MEDTING may terminate or suspend any and all Services and your MEDTING account immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms of Use. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your MEDTING account, you may simply discontinue using the Services. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

  12. NO ADVERTISING:

    MEDTING business model is based on premium and special services for the user. No advertising is accepted on the web site.

  13. MISCELLANEOUS:

    No agency, partnership, joint venture, or employment is created as a result of the Terms of Use and you do not have any authority of any kind to bind MEDTING in any respect whatsoever. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. MEDTING shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond MEDTING's reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including "line-noise" interference). If any provision of the Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms of Use shall otherwise remain in full force and effect and enforceable. The Terms of Use is not assignable, transferable or sublicensable by you except with MEDTING's prior written consent. MEDTING may transfer, assign or delegate the Terms of Use and its rights and obligations without consent.
